Report: Hunter Biden Files, Then Withdraws, Motion for New Trial

Attorneys representing Hunter Biden—found guilty a week ago on three federal felony charges—filed and then quickly withdrew a motion for a new trial in Delaware federal court.

Fox News is reporting the legal team, led by attorney Abbe Lowell, contended the court which convicted Biden lacked jurisdiction, since two appeals in the case remain pending.

Reuters notes that Biden is the first child of a sitting president to be convicted of a felony while the president was in office.

Hunter Biden was convicted of lying about illegal drug use on a federal Form 4473 when he bought a handgun in 2018.

According to a report at The Independent, attorney Lowell contended in the motion that the court “empaneled the jury on June 3, 2024 and proceeded to trial, it was without jurisdiction to do so” because there were motions before the Third Circuit Court of Appeals which were still pending.

Hunter Biden faces a maximum prison sentence of 25 years for all three charges, although most observers do not expect him to draw that kind of jail time, if any. He could also be fined up to $750,000.

The case lasted about a week and the jury deliberated only about three hours over the course of two days before handing down the verdict. Sentencing will occur sometime later in the year, though a date has not been set.

It is the latest act in a saga which has played out over the past several years, beginning with the discovery of Hunter Biden’s controversial laptop computer. Initially said to be a concoction of Russian agents attempting to interfere with the 2020 presidential election—and dismissed by many in the media as a hoax—the trial brought forth a witness who said the laptop actually was Bidens, and that the FBI has had it. So far, there has been no acknowledgment by the establishment media that reports were wrong about the laptop.

According to Fox News, the defense contended that Hunter Biden did not consider himself an active addict, although prosecutors were able to convince the jury otherwise. Biden even wrote about his substance abuse in his memoir, titled “Beautiful Things.”

President Joe Biden has told reporters he will not pardon his son.
