A U.S. District Court judge has blocked the ban on Glock-type firearms, which was supposed to take effect Thursday, saying in a 12-page ruling the law is “likely unconstitutional under the Second Amendment to the United States Constitution.”
District Court Judge Kari A. Dooley, a 2018 Donald Trump appointee, issued the ruling just hours before the gun control law was to take effect. According to WTNH news, the law—which passed along party lines earlier this year—was quickly challenged by Glock.. The law, House Bill 5043, was the Democrats’ “response to gun violence prevention advocates and police chiefs who warned of the proliferation of illegal devices that can turn a semiautomatic handgun into an automatic weapon,” WTNH reported.
In her ruling, Judge Dooley noted, “Specifically, the Plaintiffs argue that the tradition of firearms regulation in this country is to outlaw modification of legal firearms into illegal ones…For example, when confronted with the dangerousness of a ‘sawed-off shotgun’ the response was to ban the modified shotgun, not to ban shotguns altogether.”
Courthouse News is reporting that Connecticut Attorney General William Tong “does not agree with the court and will continue to defend the law.”
The law was signed in June by Democrat Gov. Ned Lamont. It was supported by gun prohibition lobbying groups including the billionaire-backed Everytown for Gun Safety.
WFSB news is reporting that Tong is likely to appeal, but in the meantime, “gun shops can continue selling the pistols while the case proceeds through federal court.”
WTNH reported hearing from Republican State Sen. Rob Sampson, who opposed the legislation.
“The law was poorly conceived, difficult to apply fairly, and targeted lawful firearms based on what a criminal might illegally do with them,” Sampson reportedly stated.
On the other hand, Democrats are flustered, as revealed in a joint statement from Sens. Bob Duff and Martin Looney:
“A switch turns a handgun into a machine gun. That’s not a Second Amendment right. We’ll keep fighting in court to keep our communities and police officers safe from dangerous and deadly overpowered firearms. A Trump-appointed judge’s tortured interpretation of the Second Amendment won’t deter us from our sworn constitutional responsibility to protect our citizens.”
