US PALM and B&T USA Announce EOS Suppressor Line

US PALM has announced that its EOS suppressor line, manufactured under license by B&T USA, is uniquely positioned following the federal court injunction in Silencer Shop Foundation v. ATF, which took effect on Aug. 13.

The landmark ruling creates unprecedented opportunity for qualifying consumers to acquire EOS suppressors without the traditional federal NFA registration process, the company said in a release posted to The Outdoor Wire.

The ruling bars enforcement of the National Firearms Act’s suppressor registration and transfer requirements against the named plaintiffs in the case and their customers. This creates a historic opportunity for downstream customers of B&T USA-made suppressors (which include US PALM EOS suppressors) to acquire covered suppressors through a significantly streamlined process.

While much of the suppressor industry is still evaluating the implications of the injunction, EOS occupies a unique position in the market. EOS suppressors are produced under license by B&T USA, a named plaintiff in the case. According to a guidance alert from Michael Faucette, counsel to the commercial plaintiffs and a partner at Wiley Rein LLP, the court’s opinion extends relief throughout the commercial distribution chain, covering distributors, dealers, and downstream customers of suppressors manufactured by the commercial plaintiffs. As EOS suppressors are manufactured under license by B&T USA, covered EOS suppressors may fall within the scope of the injunction as they move through normal commercial channels, subject to compliance with all applicable federal, state, and local laws.

Customers must still complete an ATF Form 4473, pass a background check, and comply with all applicable federal, state, and local laws, as all Gun Control Act requirements remain in effect.
